Privacy Policy (“Policy”)
Evology Autopay is provided by Parkingeye Limited trading as Evology Autopay (“We”, “Our” and “Us”). We are registered in England and Wales under company number 5134454 and have Our registered office at 40 Eaton Avenue, Matrix Park, Buckshaw Village PR7 7NA. In limited circumstances, as notified to you “We, “Our and “Us” may also mean our client, where the Automated Billing System is only available to users selected by or authorised by a specific client and is available only in that client’s car parks.
This Policy will apply to anyone who views or uses the Website including anyone who registers for an Evology Autopay Account (“You” and “Your”) and tells You what to expect when We collect Personal Data from You in respect of Your use of the Website and Your application and operation of an Evology Autopay Account.
In this Policy the following terms have the following meanings:
Active Vehicle: means a vehicle being identified by its vehicle registration number which has been added to and is actively recorded on Your Evology Autopay Account;
Auto Restore Balance: means a request via Recurring Payment Authority to increase Your Balance to the Auto Restore Balance Point, once Your account Balance equals £0.00 or if the processing of the Transaction Charges would reduce the Balance to a value below £0.00;
Auto Restore Balance Point: means either the value set by You as part of Your account registration or as amended by You from time to time by changing Your Payment Preferences;
Auto Top-Up: means a request made via the Recurring Payment Authority to add the Auto Top-Up Amount to Your Balance, once Your account Balance equals £0.00 or if the processing of the Transaction Charges would reduce the Balance to a value below £0.00;
Auto Top-Up Amount: means either the value set by You as part of Your account registration or as amended by You from time to time by changing Your Payment Preferences;
Automated Billing Parking Tariff: means the rate payable by the Evology Autopay Account holder at each Website, being sums equal to the Parking Tariffs, or, in the case of Discounted Parking Tariffs, less than the Parking Tariffs required to park, payable to the Car Park Operator under the Parking Contract;
Automated Billing System: means this web-based pay as you go parking tariff payment application;
Balance: means the sums available for payment of the Transaction Charges held in Your Evology Autopay Account;
Car Park Operator: means the owners of car parks or third parties who manage the car park on their behalf with whom We have agreed that the payment of Automated Billing Parking Tariffs required to comply with a Parking Contract can be made via Evology Autopay.
Data Protection Legislation means all applicable data protection and privacy legislation in force from time to time in the UK including the UK GDPR; the Data Protection Act 2018 (DPA 2018) (and regulations made thereunder) and the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426) as amended and all other legislation and regulatory requirements in force from time to time which apply to a party relating to the use of Personal Data (including, without limitation, the privacy of electronic communications); and the guidance and codes of practice issued by the Information Commissioner or other relevant regulatory authority and applicable to a party;
“Discounted Parking Tariffs” means the alternative parking rates offered instead of the Parking Tariff to Motorists authorised to use the Automated Billing System as confirmed by the Car Park Operator and/or the Evology Autopay Solution Operator;
Failed Payment means a scenario where We have been unable to obtain authorisation from Your bank for Your payment against the Recurring Payment Authority;
Evology Autopay: means the services provided by Us to those who hold an Evology Autopay Account to pay Automated Billing Parking Tariffs due to a Car Park Operator;
Evology Autopay Account: means a facility for users to apply for and administer an account which enables automated payments of Parking Tariffs;
Evology Autopay Solution Operator: means: Parkingeye Limited a company incorporated in England and Wales whose registered office is at 40 Eaton Avenue, Matrix Park, Buckshaw Village, Chorley, PR7 7NA with company number 05134454, who support and host the services.
Manual Top-Up: means a request made by You to add to Your Balance;
Motorist: means the driver of an Active Vehicle, who enters into a Parking Contract with the Car Park Operator;
Parking Contract: means the terms and conditions which apply in respect of parking between the Motorist and the Car Park Operator, including the payment of Automated Billing Parking Tariffs, which will be made available by the Car Park Operator, usually at the time of parking via signage at the car park;
Parking Tariff: where applicable, means the pay onsite tariffs applicable to park at the car park, as advertised by the Car Park Operator for payment by means other than the Automated Billing System;
Pay-As-You-Park: means the method of increasing Your Balance to pay the Transaction Charges on an individual occurrence basis, where the value of the requested payment is calculated as either; being a sum equal to the value of the Transaction Charges or the difference between the Balance and the Transaction Charges, whichever is the lesser;
Payment Card: means the debit or credit card registered for the Recurring Payment Authority;
Payment Preferences: means the method of payment selected by the Evology Autopay Account holder to increase their Balance being either: Auto Balance Restore, Auto Top-Up, Manual Top-Up or Pay-as-You-Park;
Payment Processor: means the payment processing services provider selected by the Evology Autopay Solution Operator to provide the payment processing facility;
Recurring Payment Authority: means the arrangement You enter into with Us and Your bank where You give Us permission to request payments as Auto Top-Ups, Auto Restore Balance and/or Pay-As-You-Park from Your Payment Card on an ad hoc basis;
UK GDPR: means the provisions of the General Data Protection Regulation (EU) 2016/679 retained by the UK;
Website: means autopay.evologyparking.com and all sub-domains or as notified to You on registration and thereafter from time to time; and
Controller, Processor, Data Subject and Personal Data and Processing shall have the meanings given to them in the Data Protection Legislation.
By using the Website and/or applying for an Evology Autopay Account You consent to Us collecting and Processing the Personal Data (including sensitive Personal Data) that You provide in relation to Your application or during the course of Your correspondence and communication with us.
You further consent that We may share information provided to us or that We have collected with the following:
- the Evology Autopay Solution Operator, for administering and Processing the Evology Autopay Account;
- the Car Park Operator, to identify if an Evology Autopay Account is held for an Active Vehicle;
- the Car Park Operator, to inform them of the details of Your payment status e.g “paid” or “Failed Payment”; and
- the Payment Processor, for the Processing of payment transactions via the Payment Processor, on behalf of Us,
and that they are duly authorised processors of that information for the purposes of administering the Evology Autopay Account. We shall only share information that is necessary for provision of Evology Autopay to You.
The Evology Autopay Solution Operator shall be the Controller of information provided by You for the purposes of the Data Protection Legislation, save for where the Automated Billing System is only available to users selected by or authorised by a specific client and is available only in that client’s car parks, where our client will be the Controller. The Payment Processor and the Car Park Operator shall be the Processors for and on the behalf of Us for the purposes of the Data Protection Legislation.
By submitting information, You consent or confirm that the person on whose behalf You are submitting that information consents, to the use of the information as set out in this Policy.
Use of the Personal Data
We will collect and process Personal Data from You for the following purposes:
- to register Your Evology Autopay Account on this Website;
- assessing Your application for an Evology Autopay Account;
- communicating with You in respect of the Evology Autopay Account;
- to inform Car Park Operators that an Evology Autopay Account is held for Active Vehicles, including the specific vehicle registration number/s;
- communicating with Car Park Operators to confirm if a payment in respect of a Parking Contract has been successful;
- communicating with Car Park Operators in respect of any complaints;
- providing You with information about the Evology Autopay Account and Your cancellation rights;
- to cancel or vary an Evology Autopay Account;
- sending emails and SMS automated alerts relating to the issue, management, maintenance and renewal of Evology Autopay Accounts, as well as in the provision of related technical support;
- to notify You about changes to Evology Autopay;
- to administer Evology Autopay and the Website for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
- to ensure that content from the online service is presented in the most effective manner for You and for Your computer;
- as part of efforts to keep the service and Website safe and secure;
- to measure or understand the effectiveness of notifications, and to deliver better notifications to You; and
- to provide You with information about other goods and services which You may be interested in where You have opted into promotional communications.
Applications and Account Maintenance
Information You supply (or that You make available) to Us, the Payment Processor or the Evology Autopay Solution Operator, in order to apply for an Evology Autopay Account or receive Evology Autopay may include, for example:
- Your name;
- Vehicle Registration Mark (VRM);
- Vehicle make and model
- Postal address;
- email address;
- Telephone number;
- A unique password or reference to access; and
- Payment Card data (to the Payment Processor only).
Any details that We ask for You to provide, are required to process Your application for an Evology Autopay Account, and/or to administer the Evology Autopay Account, including the Processing of payments. Information supplied to Us, the Evology Autopay Solution Operator or Payment Processor is subject to confidentiality and will not be disclosed except in line with this Policy.
Depending on the content of Your communications with Us, the information You supply may be classed as sensitive Personal Data. By using the Website and/or applying for an Evology Autopay Account You consent to the Processing of this information by Us, the Evology Autopay Solution Operator and/or Car Park Operator. This information will only be used as necessary to administer Evology Autopay and no other purpose.
We, the Evology Autopay Solution Operator and/or Payment Processor may retain any information supplied, documents uploaded or issued to Us by You as part of Your application, or in respect of any communications with Us in in respect of Your account for the duration of Your account, or, where necessary, for financial audit purposes or legislative requirements. However, We, the Evology Autopay Solution Operator and/or Payment Processor, will not ask You for any more information than We, the Evology Autopay Solution Operator and/or Payment Processor need, and We, the Evology Autopay Solution Operator and/or Payment Processor will not retain Your information for any longer than required.
Disclosure of Personal Data
We do not share information about You unless it is necessary for the provision of Evology Autopay. We will only share Your information as described within this Policy with parties that are either subject to this Policy or follow practices at least as protective as those described in this Policy.
You agree that We have the right to share Your Personal Data with:
- Third Party Service Providers: These are businesses that perform functions on Our behalf. Examples include the Payment Processor who manages the administration of payment transactions, postal mail and e-mail providers. (Each third party provider only has access to the Personal Data necessary to perform its functions, and may not use it for any other purpose. Further, they must process Personal Data in accordance with this Policy and as permitted by applicable Data Protection Legislation.
- Car Park Operators: We will share details of all Active Vehicles with Car Park Operators to enable them to identify if Automated Billing Parking Tariffs may be requested via Evology Autopay. Where a Carpark Operator requests payment of a Parking Tariff We will share with the Car Park Operator the status of the payment request. We will not share Payment Card data with the Car Park Operator.
- When required by Law: We may release account and other Personal Data when it is appropriate to do so in accordance with the law or where required to enforce or apply Our terms and conditions.
- With Your consent: other than as set out above, You will receive notice if We wish to share information about You with third parties. You will have the opportunity to advise Evology Autopay that You do or do not want Your information shared and Evology Autopay will comply with Your wishes.
Storing Your Personal Data
We will take all steps reasonably necessary to ensure that Your Personal Data is treated securely and in accordance with this Policy.
All information You provide is stored on secure servers. Any payment transactions will be encrypted and processed via the appropriately authorised Payment Processor. Payment information shall be stored externally by the Payment Processor and subject to this Policy.
We ask You to keep safe and to not to share a password provided in relation to accessing certain areas of this Website with anyone else.
Unfortunately, the transmission of information via the internet is not completely secure. Although We will do Our best to protect Your Personal Data, We cannot guarantee the security of Your Personal Data transmitted to Our Website; any transmission is at Your own risk. Once We have received Your Personal Data, We will use strict procedures and security features to prevent unauthorised access.
Marketing and Promotional Preferences
You can manage Your marketing and promotional preferences by logging into Your Evology Autopay Account. You can also manage Your subscriptions by following the subscription management instructions contained in any promotional emails or text messages that we may send to You. You may choose to subscribe to some methods of communication and may choose not to subscribe to others. You may update Your subscription preferences at any time (including the ability to unsubscribe). Please note that even if You decide not to subscribe to, or to unsubscribe from promotional messages, we may still need to contact you with important transactional (i.e. non-promotional) information related to Your Evology Autopay Account. For example, if you have unsubscribed from promotional email messages, You may still receive emails when a payment fails to be processed on your Evology Autopay Account.
Accepted Use of Payment Card Data
When You register Your Payment Card details or make a Manual Top-Up, You accept that You will be redirected to a separately hosted web page of the Payment Processor and any Personal Data that You supply, via Payment Processor, will be collected and processed by the Payment Processor only for making a Manual Top-Up. Here You will provide your payment card number, expiry date and security code to the Payment Processor and We will be supplied (by the Payment Processor) with the status of the payment and the payment amount, e.g. “paid”, “£10” to enable Us to allocate the payment made to Your account.
We shall keep Your Personal Data secure by applying security processes that are appropriate to the nature of the information that You provide. As the transmission of information via the internet is not completely secure, We cannot guarantee the security of Your information as it is transmitted to our Website over the internet. As such, You acknowledge and accept that any such transmission is at Your risk.
We will only process information that You supply whilst making a Manual Top-Up or registering Payment Card details via the Payment Processor and We will not be permitted access to this information, save for the status of the payment, the payment amount, the payment’s reference and the last four numbers of the Payment Card, and the expiry date of the Payment Card.
The Payment Processor facilitates Payment Card transactions that are carried out when redirected from the Website. The Payment Processor provides a payment facility only, via its own independent site. Accordingly, the payment transaction is solely between You and Us, with the Payment Processor acting as the payment facilitator. All payments are processed in line with PCI compliance and your card details are not held or accessible by Us as the Evology Autopay Solution Operator.
Your Access to Your Personal Data
We try to be as open as it can be in terms of providing You access to Your Personal Data. You can find if We (or Our agents and sub-contractors, acting on Our behalf) hold any Personal Data by making a ‘subject access request’ under the Data Protection Legislation. If We (or Our agents and sub-contractors) do hold information about You We will:
- give You a description of it;
- tell You why We (or Our agents and sub-contractors, on Our behalf), are holding it;
- tell You who it could be disclosed to; and
- let You have a copy of the information in an intelligible form.
To make a request for any Personal Data We (or Our agents and sub-contractors) may hold, You will also be required to provide Us with evidence of Your identity in order to verify the legitimacy of Your request. Changes to Our Privacy Policy
Any changes We make to Our Policy in the future will be posted on this page and, where appropriate, notified to You via the e-mail address provided when You created Your Evology Autopay Account. We recommend that you frequently check to if any updates or changes to Our Policy have been made.

We try to meet the highest standards when collecting and using Personal Data. For this reason, We take any complaints We receive about this very seriously. We encourage people to bring it to Our attention, if they think that Our (or Our agents and sub-contractors on Our behalf’s) collection or use of information is unfair, misleading or inappropriate. We would also welcome any suggestions for improving Our procedures.
